Terms of Service

The agreement between you and Odyssey when you use the website, dashboard, playground or API.

Agreement

These Terms of Service (the “Terms”) govern your use of Odyssey, including the website at odysseyapi.tech, the dashboard, the playground and the Odyssey API (together, the “Service”), operated by Odyssey (“Odyssey”, “we”, “us”).

By creating an account, creating an API key or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms for it, and “you” includes that organisation. If you do not agree, do not use the Service.

Eligibility and accounts

  • You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Service.
  • You must give accurate information when you sign up and keep it up to date.
  • You are responsible for everything that happens under your account and your API keys. Keep keys secret, do not embed them in client-side code, and revoke any key you believe has been exposed. Usage made with your keys is billed to you, whether or not you authorised it.
  • You may not share an account between unrelated people, or create accounts to obtain additional sign-up credit.

The service

Odyssey gives you one API to reach AI models developed by third parties. We choose how each request is served and may change the infrastructure behind a model at any time. The model you name in a request is the model that runs it; we do not silently replace it with a different model.

We may add, change, suspend or retire models, features and endpoints, and change prices, at any time. A price change applies to requests made after it takes effect, never to requests already made. We aim to keep the Service available but do not promise any particular uptime, and models can be temporarily unavailable.

Credits, plans and payments

  • Pay as you go. Requests draw down a prepaid credit balance at the model's listed rate on the Pricing and Models pages at the time of the request. Where a response is cut short, you are charged for what was delivered.
  • Plans. A plan (Pro, Pro+, Max, Ultimate or Odyssey) is sold for one month of 30 days, paid in advance. It gives model usage within the plan's requests-per-minute limit and its 5-hour session and weekly usage allowances, measured at the listed rates described on the Pricing page; Odyssey has none of these limits. When an allowance is used up, requests are refused until it resets, unless you choose to continue on your credit balance at pay-as-you-go rates. An upgrade starts immediately and credits the unused part of the current month against its price; a renewal or a lower plan starts when the months already bought end. A plan ends automatically at the end of its month and does not renew unless you buy another. Unused allowance does not carry over.
  • Promotional credit. Credit we grant for free, such as the sign-up bonus, is limited to one per person, has no cash value, cannot be transferred or refunded, and may be withdrawn if it was obtained in breach of these Terms.
  • Purchases. Credits and plans are bought on your Billing page and paid by card, SBP, SberPay or cryptocurrency through our payment provider. Purchased credit does not expire while your account is open, has no cash value and cannot be transferred to another account.
  • Refunds. Payments are non-refundable except where the law requires otherwise, or where we decide to refund at our discretion, for example after a billing error on our side.
  • Taxes. Prices do not include taxes unless stated. You are responsible for any taxes that apply to your purchases, other than taxes on our income.
  • If you believe you were charged incorrectly, tell us within 30 days of the charge so we can investigate.

Acceptable use

You agree not to use the Service, or let anyone else use it, to:

  • break any law or regulation, or infringe or misappropriate anyone else's rights, including intellectual property and privacy rights;
  • generate, store or distribute child sexual abuse material, or any content that sexualises minors;
  • harass, threaten, defraud or impersonate people, create spam, or produce deceptive content intended to mislead people about its origin, such as unlabelled deepfakes of real people;
  • develop malware, attack or gain unauthorised access to systems, or facilitate weapons capable of mass casualties;
  • probe, scan, overload or disrupt the Service, bypass rate limits, spend limits or billing, or try to discover or connect directly to the infrastructure and providers behind it;
  • violate the usage policies of the developer of the model you are calling;
  • resell, sublicense or redistribute raw access to the Service or your API keys as a standalone service, unless we have agreed to it in writing.

Building your own products and applications on top of the Service is allowed, provided you and your users follow these rules. You are responsible for your users' use of anything you build.

Your content and outputs

“Input” is what you send to the Service, such as prompts, messages and images. “Output” is what a model returns. As between you and Odyssey, you keep all rights you have in your Input and, to the extent the law allows, you own the Output. We do not claim ownership of either.

You give us permission to process, transmit and temporarily handle your Input and Output only as needed to provide the Service, including sending your Input to the model that serves your request. We do not store the content of prompts or responses; see the Privacy Policy for what we do keep. You confirm that you have the rights needed to submit your Input and that it does not break these Terms.

AI output

AI models can produce output that is inaccurate, incomplete, offensive or similar to output given to other people. Output is not professional advice. You are responsible for evaluating it, including with human review where appropriate, before relying on it, and for how you use it. Do not use the Service to make decisions that have legal or similarly significant effects on people without appropriate human oversight.

Third-party services

Models are created by third-party developers and served with the help of third-party infrastructure. We are not responsible for their products, and your use of a model is also subject to its developer's policies. Links to third-party websites, including Discord, are provided for convenience and are governed by those websites' own terms.

Suspension and termination

You can stop using the Service at any time, and ask us to close your account through Discord. We may suspend or terminate your access, revoke API keys, or refuse requests, with or without notice, if we reasonably believe you have breached these Terms, created risk or legal exposure for us or others, or if we are required to by law.

If we close your account without cause, we will refund any unused purchased credit. If we close it because you breached these Terms, unused credit and time left on a plan are forfeited. Sections that by their nature should survive termination, including payment obligations, disclaimers, limitation of liability and indemnity, continue to apply.

Disclaimers

The Service, all models and all Output are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted or error-free operation.

Limitation of liability

To the fullest extent the law allows, Odyssey will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service, even if we were told they were possible.

Our total liability for all claims arising from or related to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or US$100. Nothing in these Terms limits liability that cannot be limited by law.

Indemnity

You will defend and indemnify Odyssey against claims, losses and costs, including reasonable legal fees, arising from your Input, your use of Output, anything you build with the Service, or your breach of these Terms or of the law.

Changes to these terms

We may update these Terms. When we do, we will change the date at the top of this page, and for material changes we will give notice through the Service or on Discord before they take effect. Continuing to use the Service after changes take effect means you accept them.

Governing law

These Terms are governed by the laws of the jurisdiction in which Odyssey is established, without regard to conflict-of-law rules, and disputes will be resolved by its competent courts, unless the law where you live gives you the right to bring a claim in your own courts. Before starting any formal proceeding, you agree to contact us and try to resolve the dispute informally for at least 30 days.

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and Odyssey about the Service.
